Know the boundaries of your property

The placement of survey markers or boundary stones is an essential surveying step for accurately determining property boundaries. Staking is the set of operations carried out by a land surveyor to indicate, by means of markers, their opinion on the boundaries of a property. It is valid solely for the benefit of the person who requested the staking.

When the land surveyor realizes that a boundary thus determined interferes with the use of the property, they do not place markers. However, the staking operation and the determination of the boundaries remain valid, and the staking certificate issued explains the situation.

Staking operations are governed by the Regulation respecting the standard of practice relating to staking and setting out of the Ordre des arpenteurs-géomètres du Québec (R.S.Q., c.A-23, r.11).

Boundary demarcation is the surveying process used to permanently and irrevocably establish a boundary between two adjacent properties. Unlike staking, which is a unilateral operation, boundary demarcation involves the neighboring property owners. This process is often necessary when a boundary becomes disputed. Boundary demarcation can be done amicably when the neighboring property owners agree on a common position for a line separating their properties. It can be done through legal proceedings if the parties involved cannot agree.

In a boundary demarcation, the land surveyor acts as a court expert and public officer to investigate and summon witnesses. In this capacity, they recommend a boundary they believe to be the best based on their analysis and the evidence presented to them. When the land surveyor’s recommendations are accepted by the parties, they place the boundary markers and prepare the boundary survey report, which is signed by both the parties and the surveyor. This report is binding on the parties and their successors. It is registered with the Land Registry Office. If either party contests the survey, the matter may be brought before a judge of the Superior Court.

Boundary surveying operations are governed, in particular, by Articles 977 and 978 of the Civil Code of Québec and by Articles 469 to 475 of the Code of Civil Procedure of Québec.
